Last-mentioned Parties then reach an agreement to refer all disagreements that cannot be resolved through discussion or negotiation or a grievance process, to ADR UBUNTU who will then appoint an independent mediator to resolve the dispute through a process of mediation. The costs relating to the mediation process will be for the account of the Employer.
Mediation is a structured process led by a neutral third party who helps conflicting Parties reach a mutually acceptable solution. It promotes open communication, empathy, and problem-solving, helping to cultivate a culture of collaboration and reduce issues that negatively impact productivity and morale. Unlike disciplinary actions, mediation is confidential and focuses on problem-solving rather than blame, fostering trust and preserving working relationships.
As a cost-effective alternative to prolonged disputes or litigation, mediation can reduce disruptions, supporting productivity and protecting the Employer’s bottom line. By prioritizing mediation within HR practices, Employers can create a more harmonious work environment, ensuring that unresolved conflicts don’t impede team dynamics and fostering a healthier, more productive workplace culture for all.
Having immediate access to an independent and experienced mediator when HR is unable to resolve a workplace dispute is crucial and will provide the competitive edge needed. Having a mediator on call is an essential tool for every HR team wanting to make a real difference within the workplace.
Having a mediator on call will –
1) provide HR more time to focus in other key issues, 2) create less stress and cause less frustrations for HR, 3) remove HR from unnecessary workplace conflict, 4) promote HR independency neutrality, 5) promote belief and trust in HR, 5) provide access to experts, 6) guarantee confidentiality, 7) guarantee expediency and affordability in reaching outcomes.
To ensure that all Employers and Employees have access to the ADR UBUNTU mediation service, we have developed and structured a monthly subscription offering that accommodates Employers who have a single Employee to businesses and corporates who have many. The monthly fee payable and the mediation sessions that an Employer has access to, will be determined by the amount of Employees on the payroll.
